Question: I was able to resolve a dispute in Italy without the involvement of a Court, through an arbitration, as an alternative dispute resolution process. In particular, the Arbitration issued a decision, in Italian “Lodo”. Said Lodo needs to be enforced in Italy as well as in other countries, like Spain, Canada and Germany. However, some of the local authorities outside of Italy are asking for an official seal on said Lodo from an Italian government authority, as a confirmation that the Lodo is legitimate. Is there a way to satisfy such requirement? What is the involved time?
Answer: An Italian arbitration decision, or Lodo, is an Alternative Dispute Resolution (ADR) decision that can be enforced immediately in Italy.
In order to have an Italian government recognition you can file said Lodo with any Italian notary for notarial registration (i.e., registration with the notary register of deeds) and for registration with the local tax office.
Once the Lodo has been fully registered with the notary and the local tax office you can proceed with whatever formality required.
