Question: I purchased an apartment in Italy, in an apartment building. Who manages the common areas, takes care of the lift, shared parking space and other facilities used in common by the residents?

Answer: According to the Italian law, when multiple owners share the use of some areas and/or facilities, they represent a condominim (similar to the idea of a “condo” in the U.S.). In italian the concept is represented by the word “condominio“. The condominio can be either (i) regulated by a formal contract between the single owners and can be managed by a person appointed for this purpose, or (ii) informally managed by the owners/residents according to the default Italian laws applicable when there is no private agreement in place.  

Italian laws state that a formal condominio agreement must be set up if the owners sharing areas or facilities are more than 10; moreover, if the owners are more than four, it is also mandatory to appoint a formal condominio manager (in Italian “amministratore di condominio“). The individual owners have the right to vote and appoint the condominio manager. Any subject, either resident or not, can be appointed as a condomino manager.

Sometimes owners prefer to have a tacit informal agreement, to avoid condominio manager fees, especially when the management and entity of the condemnor assets are not relevant.
