Question: One of our Italian clients is no longer paying our invoices. Shall we send them a debt collection letter on your law firm letterhead?
Answer: If a client is not paying a bill, it might be a good idea to send them a more formal letter the letter heard of a law firm. When we send a formal letter, it shows your debitors that you are seriously going after them and have a concrete intention to pursue a legal action, unless they satisfy your credit.
We offer an initial debt collection service as follow:
- review case documents and information;
- exchange advice and operative notes with our client regarding legal merit;
- draft a letter-before-action to put on notice the debtor and provide a deadline to comply;
- exchange an English translation of said letter with our client and finalize its content;
- serve the letter on the debtor;
- draft legal advice to our client based on debtor’s reaction (e.g., we might receive a letter back or a call from the debtor or his/her lawyer, or we might receive notice that the letter has been successfully delivered although we do not receive any feedback from the debtor within the deadline provided in the letter; we then advise our client accordingly, including possible options, suggested action plan and related costs).
Often after our letter the debtor settles the debt directly to the creditor.
Should the debtor not comply after the registered letter, we would advise our client about possible options and costs. We tend to encourage amicable settlements without starting litigation.
