Question: How do you define an Italian luxury property?
Answer: The definition of luxury can be very subjective depending on how one measures desirability, comfort and cost. From a tax perspective we can define an Italian luxury property by specific parameters.
Italian Luxury Home Definition
The definition of Italian luxury property in the Italian tax system is based exclusively on its classification on tax record. If the residential tax classification of the property is A1, A8 or A9, for tax purposes that property is a luxury property. More specifically, the Italian luxury property residential tax classification (or “category”) A1 applies to particularly nice apartments in particularly nice buildings. A8 applies to villas, and A9 applies to castles and apartments in historic or artistic buildings.
The tax categories for non-luxury residential properties are A2, A3, A4, A5, A6, A7 and A11. A10 is the tax category for apartments zoned for business offices.

Exceptions might apply so that, even if a property is very nice, priced substantially above median market value for the area, or is a beautiful villa or historic apartment, it might not be registered as a “luxury” property under the tax categories A1, A8 or A9. Conversely, there are cases of properties that on record are a tax category A1, A8 or A9 but, in reality, their value or appeal are not so remarkable.

Luxury Property Taxes in Italy
The owner of an Italian property categorized as luxury on tax record has access to fewer tax exemptions than those applicable to a property that is not a A1, A8 or A9. For example, you are not entitled to the lower 2% transfer tax and are subject to the 9% tax rate. This is true even if you will use the property as your primary residence. At the contrary, if an Italian luxurious home is not categorized for tax purposes as A1, A8 or A9, such tax restrictions do not apply.
However, other options might apply. Since “luxury properties” typically have a high market value, some alternative or custom estate planning solutions might make sense. A tailor-made estate plan can significantly mitigate the financial and/or tax impact of the aggravations connected to a luxury property. The cost of such solutions would unlikely make sense for less valuable properties.
What if a property has a high market value (let’s say EUR 500,000 or more) but does not have a “luxury” tax categorization on record? For such valuable properties there are other tax options and legal tools to maximize the investment, increase your protection and optimize your estate planning goals. Although such solutions are less common and rarely suggested by the Italian notary or real estate agent, they might be extremely cost effective. The more valuable the property, the wider the range of available effective options.
