Question: What are the compliance formalities to rent an Italian property?
Answer: If you rent a property for 30 or more days, you have an obligation to formalize the contract into a written lease agreement and register it with the Italian tax authorities.
Default long term rent rules apply
If rent is shorter than 30 days, it is not subject to rental contract registration nor to long term rent duties. However, if rent is shorter than 30 days you have an obligation to file the guests’ information with the local Police authority (Questura) within 48 hours from the beginning of their stay.
Failing to file guests’ information with the Police is a crime and therefore can be prosecuted in a criminal court.
Additionally, the Municipality (Comune) where the property is located might enforce a tourist tax to be paid by hotel and B&B guests. If that is the case, you, as the host, would be responsible to collect the tax from the guests and pay it to the Municipality.
Additional compliance formalities might apply. For example, most municipalities ask for monthly occupancy statements.
Moreover, some Regional authorities require property owners to register their B&B and get a B&B license as a requirement do short-term rentals.
Finally, if you collect any rent from an Italian property, you are required to report it into your Italian income tax return, regardless your citizenship or residency status.
