In Italy, compensation for medical malpractice is assessed through a structured legal-medical process that differs substantially from systems in other countries. One of the central components is the “percentuale di invalidità”, a legal-medical assessment that determines how much a patient’s physical or psychological integrity has been permanently or temporarily compromised.
The Role of the Forensic Medical Expert
The evaluation is carried out by a court-recognized forensic medical expert (medico legale), who issues a formal report quantifying the injury as a percentage. This percentage reflects the severity of the impairment and its impact on the patient’s overall functional ability and quality of life.
The higher the percentage of invalidity, the more significant the injury and, typically, the greater the compensation.
Compensation Parameters
Italian courts rely on standardized compensation parameters to assign a monetary value to each point of invalidity. These parameters provide for:
- a monetary value per point of permanent disability
- adjustments based on the injured party’s age
- guidelines to calculate temporary disability and non-economic losses
These parameters also aim to ensure consistency and fairness across Italian courts jurisdictions in the determination of monetary and non-monetary damages (danno non patrimoniale).
Types of compensation awards
In Italian medical malpractice cases, courts may grant compensation under two main categories:
1. Non-Economic Loss
These may include:
- Pain and suffering
- Loss of quality of life
- Permanent or temporary disability
- Psychological trauma
2. Economic Loss
These may include:
- Reimbursement of medical, surgical, and rehabilitation costs
- Loss of income or future earning potential
- Long-term or lifetime care expenses
All claims must be substantiated by documentation and, where appropriate, expert opinions and actuarial projections.
