Divorce classes in Church. Believe it or not this is happening in San Pancrazio Church in the city of Isola Farnese, close to Rome. Actually, Father Quirino’s purpose is to provide its citizens with a Rota Lawyer who can explain if they can apply for nullity of marriage.
“There are several Catholics living in a hard situation, since their marriage is over and, consequently, they are feeling very uncomfortable with their new relationships. The only solution is to check whether their religious marriage is valid or not by consulting Roman Rota Tribunal. So we asked a Rota Lawyer to help our parishioners in need” said Father Quirino.
The requirements needed to proceed and ask for a nullity of marriage are well-known, as Rota Lawyer Federica Metta, from Studio Legale Metta of Bari (Apulia), explained “we are talking of defects in parties’ consent which are related to fidelity, indissolubility and openness to procreation of offspring”.
Besides, jurisprudence added other cases such as spousal’s good, which is violated if a spouse does not take care of his or her partner.
“Canon Law lists those who are incapable of contracting marriage: those who lack the sufficient use of reason and suffer a defect of discretion of judgment concerning the essential matrimonial rights and duties mutually to be handed over and accepted”, Metta specified.
“Furthermore, a marriage is invalid if entered into because of force or grave fear from without, even if unintentionally inflicted, so that a person is compelled to choose marriage in order to be free from it. In the end we can find a unusual but a possible case: an error concerning the person invalids a marriage”.
