Question: Am I entitled to Italian citizenship if my Italian grandmother gave birth to my father prior to 1948?
Answer: If your female ancestor gave birth prior to 1948 this is not necessarily a reason to prevent your Italian citizenship status.
Let’s correct some misconceptions about Italian citizenship 1948 cases.
There are at least two that we often discuss with our clients.
Italian citizenship 1948 case process
- Some people believe that since their female ancestor gave birth prior to the 1948 Italian Constitution, they are not entitled to Italian citizenship recognition.
This is not true.
In fact, if the female descent is the only “issue” of your case, an Italian Court can affirm that such “issue” is an unconstitutional discrimination and can therefore conclude that you are an Italian citizen (see court judgement in the image of this article).
Italian citizenship by Court quicker than by Italian Consulate
- Some people believe that applying for Italian citizenship through the Italian Consulate is much easier than filing an Italian citizenship recognition Court claim and then give up on their Italian citizenship pursuit.
This is not true either. Or, at least, it is not always true.
Even if you have a “straightforward” case, Italian Consulates often schedule citizenship appointments two years out and then it might take more than a year to process an Italian citizenship by descent. Not to mention the aggravation of going to the Italian Consulate in person to file the paperwork when the time comes.
Instead, a 1948 case processed through the Court can be completed more quickly (the pictured judgment was issued under 14 months after filing) and completely remotely, without going to any Italian office in person.
In conclusion, if you are a 1948 case, getting your Italian citizenship recognition might be easier than you think.
